This Loksee Terms of Service (the "Agreement") constitutes a legally binding agreement between you ("User" or "you") and Loksee Team, (hereinafter referred to as "Loksee," "we," "us," or the "Platform"). This Agreement governs your use of the Loksee software and its related services, which include, but are not limited to, AI browser, private cloud storage, AI scanning, AI toolbox, etc., collectively referred to as "the Services").

PLEASE READ THIS AGREEMENT CAREFULLY BEFORE USING THE SERVICES. YOUR USE OF THE SERVICES CONSTITUTES YOUR ACCEPTANCE OF THIS AGREEMENT AND YOUR AGREEMENT TO BE BOUND BY ALL ITS TERMS AND CONDITIONS.

Important Notices

A. Nature of Services
Loksee is an AI-integrated intelligent browser and file management tool. It leverages advanced artificial intelligence technologies to assist users in browsing the web, managing files, and processing documents more efficiently.

B. Neutrality Statement
Loksee functions solely as a provider of technical tools. We offer private storage space, link navigation, and AI-powered processing utilities. Loksee does not directly upload, host, or provide content, nor do we modify content transmitted by users, except when executing specific AI instructions given by the user. We exercise no control over the content of third-party websites accessed through our browser and do not guarantee the accuracy, legality, or reliability of content generated by our AI features.

C. Limitation of Liability
This Agreement contains important provisions that disclaim or limit our liability, outline your responsibilities, and specify the methods for resolving disputes and the applicable jurisdiction. Please review these sections closely.

D. Age Restriction
You must be at least 13 years of age (or the age of legal majority in your jurisdiction, whichever is higher) to use the Services. We do not knowingly collect personal information from children under 13 without verifiable parental consent.

1. Services Description
Loksee provides users with the following core services:
1.1 Intelligent Browser Service: Enables access to third-party websites on the internet, provides resource detection, webpage rendering, and intelligent search capabilities.
1.2 Personal Cloud Storage & Cloud Transfer Service:

• Cloud Storage: Allows for the upload, storage, management, and preview of files.
• Cloud Transfer: Utilizes proxy access technology to enable users to save content directly from the web to their private cloud space.
  1.3 AI-Powered Tools: Includes, but is not limited to, AI Scanning (OCR), AI Document Analysis, AI Translation, and entertainment-focused functions such as AI Fortune Telling/Horoscope readings.

2. Account Registration and Security
2.1 Registration Information

You may access or use some Services or features without registration. You may be required to register an account ("Account") with us to access or use certain features of the Services. You can login the Services via your Apple account or Google account. You agree to provide and maintain accurate, current, and complete information.

2.2 Prohibition on Account Sharing

To ensure the security of cloud data and protect membership privileges, you are strictly prohibited from gifting, lending, leasing, transferring, or selling your account to any third party. Loksee reserves the right to temporarily suspend or permanently terminate accounts, without prior notice, if we detect anomalous multi-device login patterns or any activity indicative of account sharing.

2.3 Security Responsibility

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Loksee shall not be liable for any loss or damage (including data loss or consumption of AI usage quotas) arising from your failure to secure your account. You must notify Loksee immediately upon becoming aware of any unauthorized use of your account.

3. Acceptable Use and Anti-Abuse Policy
3.1 Lawful Use
You agree to use the Services in full compliance with all applicable local, national, and international laws and regulations. You expressly agree NOT to use the Services to publish, upload, transmit, distribute, store, or create any content that:

• Endangers National Security: Compromises state secrets, subverts state power, undermines national unity, or threatens national security.
• Incites Hatred or Division: Promotes racial, ethnic, or religious hatred, discrimination, or sectarianism; incites illegal assemblies or protests.
• Facilitates Illegal Activity: Constitutes, encourages, or provides instructions for criminal offenses.
• Is Offensive or Harmful: Is defamatory, obscene, pornographic, violently graphic, harassing, threatening, hateful, or discriminatory.
• Infringes Rights: Violates any patent, trademark, trade secret, copyright, privacy, or publicity right of any party.
• Contains Malware: Includes viruses, corrupted data, or other harmful code designed to disrupt or gain unauthorized access.

3.2 Prohibited Conduct
While using the Services, you shall NOT:

• Interfere with or disrupt the Services or the experience of other users.
• Use the Services for any unlawful or unauthorized purpose.
• Attempt to modify, adapt, hack, emulate, or reverse engineer any portion of the Services.
• Circumvent, disable, or otherwise interfere with security-related or content-filtering features.
• Disseminate false information or the personal information of others without consent.

You are strictly prohibited from using Loksee services to create, store, solicit, or distribute:

• Content that sexually exploits or depicts minors.

• Content depicting or encouraging sexual activities involving minors.

• Content that inappropriately targets minors with sexual, violent, or obscene themes.

Upon identification of any such content, we will promptly:

1. Permanently remove all related content.
2. Terminate the associated user account immediately and permanently.

Report the incident and all relevant information to appropriate authorities and fully cooperate with law enforcement agencies.

3.3 Special Provisions for Cloud Transfer
The "Cloud Transfer" function acts as a technical proxy tool.

• By entering a link or using the save feature, you authorize Loksee's servers to access that link on your behalf and store the retrieved content in your private space.
• You are solely responsible for ensuring you possess the legal right to access and save such content. Loksee assumes no responsibility for the copyright compliance of content sourced from third-party websites.

4. AI Services Usage Terms
4.1 AI Scanning and OCR
Using AI Scanning involves uploading images for processing. While we strive for accuracy, AI recognition is not infallible and may contain errors. Loksee disclaims liability for any loss or consequence resulting from such recognition errors.

4.2 AI Documents and Q&A (Hallucination Disclaimer)
Loksee's AI assistant utilizes Large Language Models. AI-generated content, including summaries, answers, and translations, may contain "hallucinations"—plausible-sounding but incorrect or fictitious information. Such content is provided for reference only and does not constitute legal, medical, financial, or other professional advice.

4.3 AI Entertainment Functions
Features such as AI Fortune Telling, Tarot, and Horoscope readings are designed solely for entertainment purposes. You should not rely on them for making significant personal, financial, or life decisions.

5. Intellectual Property
5.1 Loksee's Intellectual Property
All intellectual property rights in the Loksee software, user interface, designs, logos, algorithms, and the Services themselves are and shall remain the exclusive property of Loksee and its licensors. Unauthorized reproduction, reverse engineering, or data extraction is prohibited.

5.2 Your Content and License

1. You or the original rights holder retain intellectual property rights to the files you upload to your Loksee Cloud Drive.
2. Necessary License: To provide and improve the Services (e.g., generating previews, AI analysis, format conversion), you grant Loksee a worldwide, royalty-free, non-exclusive license to use, host, store, reproduce, modify, and analyze your content solely for operational and technical purposes.

5.3 Copyright Infringement Policy
Loksee respects intellectual property rights and operates a robust notice-and-takedown procedure.

1. Report: If you find anything on the Services infringing upon intellectual property rights which you own or control, you may notify us of such infringement dmca@mail.lokseeai.com.
2. Repeat Infringers: Accounts of users who are repeat infringers will be terminated.
3. Action: Upon receipt of a valid notice, we will act expeditiously to remove or disable access to the infringing content.

6. Subscriptions for Premium Services

We offer most of the features of the Services to you for free. But you may also subscribe certain features of the Services ("Premium Services") and pay subscription fees ("Subscription Fees") before you can use them. The Premium Services are available to users of Apple iOS version of the Services and who has a valid Apple ID account, and users of Android version of the Services and who has a valid Google ID account.

The price for Subscription Fees is solely determined by us and will be displayed on the Services at the point of purchase. We reserve the right to change the price for the Premium Services from time to time and/or the features and functions available with the Premium Services in any manner and at any time as we may determine in our sole and absolute discretion, and we will use commercially reasonable efforts to communicate any such changes to you in advance. 7. Disclaimers and Indemnification
7.1 Service "As Is" and Availability
The Services are provided on an "as is" and "as available" basis. Loksee does not warrant that the Services will be uninterrupted, error-free, or meet your specific requirements. We are not liable for interruptions or data loss caused by force majeure events, network issues, or third-party service failures. You are advised to maintain your own backups of important data.
7.2 Third-Party Content and Links
Any third-party websites, content, or resources accessed via the Loksee Browser are the sole responsibility of the respective third parties. Loksee assumes no liability for their content, services, or privacy practices.
7.3 Indemnification
You agree to indemnify, defend, and hold harmless Loksee, its affiliates, officers, directors, and employees from and against any and all claims, liabilities, damages, and expenses arising from your breach of this Agreement, your misuse of the Services, or your infringement of any third-party rights.
7.4 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LOKSEE'S AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE SERVICES, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU HAVE PAID TO LOKSEE IN THE ONE (1) MONTH IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR (B) ONE HUNDRED US DOLLARS (USD $100).

8. Governing Law
This Agreement, including its formation, interpretation, and enforcement, shall be governed by and construed in accordance with the laws of Singapore.

9. Miscellaneous
9.1 Modifications
Loksee reserves the right to modify this Agreement at any time. We will provide notice of such changes, which may be posted within the Services or on our website. Your continued use of the Services after the effective date of the revised Agreement constitutes your acceptance of the terms.
9.2 Notices
Notices from Loksee may be delivered via in-app notifications, announcements on our website.
9.3 Reporting Abuse
